Short-term rentals, tight setbacks on deck as Board of Adjustment meets Monday

The Lexington-Fayette Urban County Board of Adjustment on Monday will weigh a slate of short-term rental permits — including two flagged for denial over past violations — and two setback variances that could reshape corners of Picadome and Smithtown.

Several un-hosted short-term rentals are up for conditional use permits, a recurring flashpoint as Lexington continues to balance neighborhood concerns with tourism dollars. Staff recommends denying applications at 808 Gunpowder Drive (Mint Pillow Property Management LLC) and 3112 Glenwood Drive (Glenwood Retreat LLC), citing “a documented history of compliance issues” and the risk of creating a neighborhood nuisance. In the Glenwood case, staff also notes an existing rental within 600 feet, pushing concentration above policy thresholds.

At the same time, staff backs permits for six other un-hosted rentals — on Barnard Drive, Stonewood Lane, Greenway Lane, Oleander Drive (with a lower occupancy cap of eight), N. Broadway Park, and Liberty Road — finding the homes large enough to host the proposed headcounts, adequate off-street parking, no nearby nuisance citations, and low local concentrations of rentals. Several approvals are conditioned on business licensing and zoning compliance, and some include occupancy limits ranging from four to ten guests.

On variances, a Picadome-area request at 117 Vista St. (District 10) seeks to shrink a required side yard from 8 feet to 2 feet and a corner side street setback from 30 feet to 1 foot. Staff recommends approval with conditions — including removing a front driveway and keeping a rear porch unenclosed — arguing the changes won’t harm public safety and would match longstanding block patterns dating to the home’s 1937 build. “Properties within the immediate vicinity feature non-conforming side-yard setbacks,” staff writes.

A separate infill case at 536 W. Fifth St. (District 1) would push a multifamily building closer to the lot lines. Staff supports reducing one side yard from 5 feet to 3 feet but opposes cutting the corner side setback from 5 feet to 4 feet, warning the latter would “negatively impact the walkability of the area” and isn’t justified under Kentucky’s variance standards. A redesigned floor plan, staff says, could meet the code without relief.

Also on the agenda: a long-running rural short-term rental case at 2593 Berea Road (Cane Manor LLC, A-R zone) returns as a postponement item. The board has tabled it three times since April; staff notes the applicant has not amended the filing, and no further review has occurred — a sign the rural rental remains unresolved.

What to watch: Expect public comment and potential board debate around the two recommended denials tied to prior violations, as well as the tight corner setbacks at Vista Street and the Fifth Street infill project, where staff explicitly raises walkability concerns. Routine approvals carry occupancy caps and licensing conditions that can be enforced if problems arise.
