Republican Attorney General Russell Coleman has filed a civil lawsuit against Mayday Health for advertising mail-order abortion pills in Kentucky.
Mayday Health, a New York-based reproductive health education nonprofit, has advertised these drugs at gas stations and with a banner attached to an airplane over the Kentucky State Fair, according to a news release.
The lawsuit, filed in Logan County Circuit Court, alleges Mayday Health violates the Kentucky Consumer Protection Act and asks the court to order the organization to permanently stop its illegal advertisements and to pay penalties.
“These out-of-state activists are not only breaking Kentucky law, they seem to delight in rubbing our faces in it,” Coleman said in the release. “The State Fair is a beloved Kentucky tradition for families and children to celebrate our Commonwealth. We refuse to allow Mayday to taint our values and put our people at risk.”
Leo Raisner, Mayday Health executive director, defended the organization’s advertisements in a statement printed in the Lexington Herald-Leader: “We look forward to defending our First Amendment-protected work in court — and winning, like we have against similar efforts to suppress our speech. Abortion pills are safe, effective and FDA-approved, and everyone deserves access to that information.”
“In 2022, the General Assembly prohibited the mailing or delivery of abortion-inducing drugs in Kentucky. In addition, Kentucky’s Consumer Protection Act prohibits deceptive or misleading communications with Kentuckians,” according to the release.
