LEXINGTON, Ky. — A Danville businessman has been indicted on 20 federal counts accusing him of failing to pay over more than $400,000 in payroll taxes withheld from employees of his company, according to court records unsealed Thursday.
A grand jury charged Stuart Gregory Wells, owner of Allcall Business Development Center in Boyle County, with repeatedly withholding federal income, Social Security, and Medicare taxes from his workers’ paychecks but never sending the money to the IRS. The alleged failures stretched from late 2019 through mid-2024, filings show.
Prosecutors say Wells was responsible for filing quarterly tax returns and remitting the withheld “trust fund” taxes, along with matching employer contributions, but willfully failed to do so. The indictment lists 20 separate quarters in which required payments went unpaid, ranging from about $13,500 to more than $26,000 per quarter, for a total that exceeds $400,000.
Among the missed payments cited:
- $24,126 due after the third quarter of 2019,
- $24,629 due after the third quarter of 2021, and
- $26,104 due after the final quarter of 2023.
If convicted, Wells faces up to five years in prison on each count, fines of up to $250,000 per count, and possible restitution to the government.
Allcall Business Development Center, based in Danville, described itself as a business services company. The indictment alleges Wells controlled payroll and finances, making him the person legally responsible for ensuring the company paid its employment taxes.
The case has been assigned to U.S. District Judge Karen K. Caldwell, with Magistrate Judge Matthew A. Stinnett handling preliminary matters. Assistant U.S. Attorney Andrea Mattingly Williams is prosecuting.
Wells has not yet entered a plea. A summons is expected to be issued for his first court appearance.
